Enter your dates and we'll show your Texas notice and lien deadlines under the Property Code as amended for original contracts entered into on or after January 1, 2022. It takes about 20 seconds.

How Texas lien deadlines work

Texas deadlines don't count days. They run to the 15th of a month, counted from the month of your work. A sub or supplier on a commercial job who last worked in March has a notice deadline of June 15 for March's work and a lien deadline of July 15. On a residential job, both deadlines are a month shorter.

  • Subs and suppliers send a notice of claim to the owner and the original contractor for each month of unpaid work (§ 53.056).
  • Original contractors don't send that notice, and their lien deadline counts from the month the original contract was completed, terminated or abandoned (§ 53.052(a)).
  • Residential means a home owned and lived in (or meant to be lived in) by its owner (§ 53.001). A builder-owned spec home can follow the commercial deadlines.
  • Retainage has its own notice and a lien deadline tied to when the original contract ends (§§ 53.057, 53.052(d)). Retainage claims →
  • Homesteads need a written contract signed before work began and filed with the county clerk (§ 53.254). Homestead rules →

Frequently asked questions

How do I calculate my Texas lien deadline?

For subs and suppliers, it's the 15th day of the 4th month after the last month you furnished labor or materials (3rd month on residential). Original contractors count from the month the original contract was completed, terminated or abandoned.

What if my deadline falls on a weekend?

Texas extends the deadline to the next day that isn't a Saturday, Sunday or legal holiday (§ 53.003(e)).

Does this work for contracts before 2022?

No. It uses the rules for original contracts entered into on or after January 1, 2022. Older contracts may follow the prior rules.

Is the calculator legal advice?

No. It's a starting point. Call us and we'll confirm your dates before you rely on them.
