Once you're paid, the lien has to come off the property. Owners, title companies and lenders will ask for a recorded release, and in Texas you're required to provide one. We prepare and record lien releases for liens we filed and for liens you or someone else filed.
Texas rule: After you're paid, you must provide a recordable release within 10 days after a written request from the owner, the original contractor or whoever paid (Tex. Prop. Code § 53.152).
Releases vs. lien waivers
A lien release is recorded with the county and clears a lien that's already on file. A lien waiver is signed in exchange for a payment and gives up lien rights for that payment. Texas waivers must substantially follow the statutory forms to be enforceable (§§ 53.281, 53.284), and no one can require an unconditional waiver until you've actually received the money in good funds (§ 53.283).
- Conditional waiver: effective only when the payment actually clears.
- Unconditional waiver: effective when signed. Only sign it after the money is in your account.
Partial payment?
If you were paid part of what you're owed, a partial release can reduce the lien to the unpaid balance instead of clearing it. Don't release the whole lien for a partial payment unless that was the deal.
