A notice of intent to lien is a final warning: pay by a set date, or a lien gets filed against the property. It's the step that often gets the check written, because it puts the owner and GC on notice that the next document goes into the county records.

Texas note: Texas doesn't require a separate notice of intent before a private-project lien. What Texas requires from subs and suppliers is the notice of claim (§ 53.056). Texas also allows an optional past-due notice to the original contractor, which isn't required for the lien to be valid (§ 53.056(a-4)). A demand letter can still be a smart move before filing.

States where a notice of intent is required

StateRequirement
MissouriEveryone except the original contractor serves the owner at least 10 days before filing, by a process server or an adult who signs an affidavit
PennsylvaniaSubs give the owner formal written notice at least 30 days before filing
KentuckySubs and suppliers send notice of intent within 75 or 120 days of last furnishing
MississippiOn single-family homes, a Pre-Lien Notice at least 10 days before filing (non-privity claimants)
LouisianaOn residential jobs with no notice of contract, a notice of nonpayment at least 10 days before filing extends the deadline to 70 days

When a notice of intent makes sense

  • You're inside your deadline and want one more chance to get paid without filing.
  • The owner may not know the GC hasn't paid you.
  • You want a paper trail showing you gave fair warning.

Don't let a notice of intent eat your deadline. Set the pay-by date so you still have time to file if it doesn't work. We help you pick that date.
