Quick answer: A Macomb County mechanics lien is a claim of lien recorded with the Macomb County Register of Deeds at 120 N. Main Street in Mount Clemens within 90 days of last furnishing, with Notice of Furnishing proof attached for subs and suppliers, then served within 15 days. See the full Michigan deadlines and statutes.

Where Macomb County liens are recorded

Macomb County liens are recorded by the Macomb County Register of Deeds, part of the County Clerk/Register of Deeds office, at 120 N. Main Street in Mount Clemens, the county seat. The office is open Monday through Friday, 8:00 a.m. to 4:15 p.m.

Macomb’s recording requirements are specific. Each document needs a correct “Return To” name and address, a 2.5-inch top margin on the first page (or a cover page with the document’s title if the first page doesn’t fit) and half-inch margins elsewhere, white paper of at least 20-pound weight between 8.5 x 11 and 8.5 x 14, black type of at least 10 points, original signatures with the signer’s name typed or printed underneath and matching the notary block, and the drafter’s name and address. Since September 18, 2018, death certificates have to be recorded on their own rather than attached to another document.

Finding the legal owner and checking the record

Like the rest of Michigan, Macomb’s cities and townships assess their own property, so we start with the local assessor for the owner and parcel number, then confirm the vesting deed and any Notice of Commencement in the Register of Deeds records.

The Register of Deeds offers Fraud Notify alerts that tell signed-up owners about recordings in their name, and an online status of recorded documents. Expect the owner to know about a lien quickly, and expect us to confirm on that status page that yours has been recorded before the 15-day service clock starts.

Cities we file in across Macomb County

Macomb County has 27 cities, townships and villages. In the south: Warren, Center Line, Eastpointe, Fraser, Roseville, St. Clair Shores and Grosse Pointe Shores. In the center: Sterling Heights, Clinton Township, Macomb Township, Shelby Township, Harrison Township, Chesterfield Township, Mount Clemens, New Baltimore and Utica. In the north: Washington Township, Romeo, Armada, Bruce, Ray, Lenox, Richmond, Memphis and New Haven.

Grosse Pointe Shores is on both Macomb’s and Wayne’s community lists, and 8 Mile Road and Dequindre Road divide Macomb from Wayne and Oakland. Check the parcel before you decide where the lien goes.

Macomb work is a mix of auto and defense plant work, warehouses, retail and new subdivisions in the townships. On the public side, Innovate Mound is a $217 million reconstruction of about nine miles of Mound Road in Warren and Sterling Heights, backed by a $98 million federal INFRA grant, which began in August 2021 and was phased over four construction seasons. Public road work runs on payment bonds, not liens.

What sinks liens in Macomb County

  • A first page with no room. Without a 2.5-inch top margin, Macomb needs a cover page with the document title.
  • Signatures that don’t match the notary block. Macomb requires the printed name under each signature to match the acknowledgment.
  • A supplier’s late Notice of Furnishing. Suppliers to subs have 20 days after first delivery to serve the designee and general contractor.
  • The wrong side of 8 Mile or Dequindre. A few blocks can put a job in Wayne or Oakland County.
  • No foreclosure within the year. A claim of lien has to be foreclosed within one year after recording. See the Michigan deadline table.

How LevelSet handles a Macomb County lien

  1. Intake. You tell us the job address, who hired you, what you’re owed, your first and last furnishing dates, and how you served your Notice of Furnishing.
  2. Statutory form. We confirm the owner through the local assessor and the recorded deed, and draft the Michigan claim of lien to Macomb’s format and signature rules.
  3. Notarization. Matt Rush swears to and signs the claim as the claimant’s agent, and a notary acknowledges it.
  4. Recording. We record it with the Macomb County Register of Deeds in Mount Clemens and confirm it on the recorded-documents status page.
  5. Service. The designee or owner is served by certified mail within 15 days after recording, and the general contractor gets a copy.

Example: a Macomb County deadline walk-through

Example: A steel supplier makes its first delivery to a subcontractor on a Sterling Heights warehouse on January 12 and its last on April 30. Its Notice of Furnishing to the designee and general contractor was due February 1 (20 days). The claim of lien has to be recorded in Mount Clemens by July 29 (90 days after April 30) and served within 15 days after recording.
