Quick answer: A Fulton County mechanics lien is recorded with the Real Estate Division of the Fulton County Clerk of Superior and Magistrate Courts, must carry the tax parcel ID, and is eFiled through an approved vendor or GSCCCA. Georgia's 90-day filing deadline and 2-business-day owner copy apply. See the full Georgia deadlines and statutes.
Where Fulton County liens are recorded
Fulton County liens are recorded by the Real Estate Division of the Clerk of Superior and Magistrate Courts, which records and indexes all Fulton County real estate deeds, lien filings and plats. The main office is on the ground floor of the Lewis R. Slaton Courthouse at 136 Pryor Street SW in downtown Atlanta, and the Clerk also runs a North Service Center on Roswell Road in Sandy Springs and a South Service Center on Stonewall Tell Road in College Park.
Fulton accepts eRecordings through Simplifile, eRecording Partners Network and CSC, and through the GSCCCA eFile portal. Electronic filings are processed in 2 to 3 business days; documents submitted any other way can take up to four weeks. Since January 1, 2025, Georgia has required most filers to eFile real estate documents with ID verification, so every Fulton lien we file goes through eFile.
Recording and enforcement are separate. The Clerk records the lien; if it has to be enforced, the lien action is a lawsuit filed within 365 days, and the Clerk's office is also where the Notice of Commencement of Lien Action gets recorded within 30 days after suit is filed.
Finding the legal owner and legal description in Fulton County
Fulton's Board of Assessors runs the county property search at fultonassessor.org (the Property Search tab), with its main office at 235 Peachtree Street NE. That's where we confirm the owner of record and the parcel ID. The parcel ID matters more here than in most Georgia counties: since August 27, 2018, HB 1036 has required tax parcel ID information on documents recorded in Fulton's real property records.
The legal description comes from the owner's vesting deed in the Clerk's real estate records, not from the street address on your invoice. On large Atlanta commercial sites, the building you worked on is often on a different parcel than the one the mailing address points to.
Cities we file in across Fulton County
Wholly in Fulton County: Alpharetta, Chattahoochee Hills, College Park, East Point, Fairburn, Hapeville, Johns Creek, Milton, Roswell, Sandy Springs, South Fulton and Union City. South Fulton is one of the county's newest cities, incorporated May 1, 2017.
Partly in Fulton County: Atlanta (also in DeKalb), Mountain Park (also in Cherokee) and Palmetto (also in Coweta). An Atlanta address doesn't guarantee a Fulton County lien.
The work we see in Fulton runs from high-rise multifamily and office interiors in Midtown and Buckhead to warehouses near the airport in College Park, Hapeville and South Fulton, and subdivisions and retail in Milton, Alpharetta and Johns Creek. On the public side, Fulton County has approved up to $1.3 billion in bonds for a new jail facility, with construction expected to start in early 2028. Public jobs like that run on payment bonds, not liens.
What sinks liens in Fulton County
- Wrong county for an Atlanta address. Part of Atlanta is in DeKalb. A lien recorded in Fulton on a DeKalb parcel doesn't protect you.
- Missing parcel ID. Fulton requires tax parcel ID information on recorded real property documents.
- Paper filing delays. A lien mailed in near the 90-day deadline can sit for weeks; eFiled documents are processed in 2 to 3 business days.
- Wrong parcel on a multi-parcel site. Downtown and Midtown projects often span several parcels with different owners.
- Missing the owner copy. Georgia's 2-business-day mailing rule applies in Fulton like everywhere else. See the Georgia deadline table.
How LevelSet handles a Fulton County lien
- Intake. You send the job address, who hired you, your invoices and your first and last days on the job.
- Property check. We pull the owner and legal description from the Fulton County Board of Assessors and confirm the parcel is actually in Fulton County.
- Statutory form. We prepare the claim of lien with the Georgia-required 395-day expiration language and the owner's right-to-contest notice, signed by Matt Rush as agent for the claimant and notarized.
- Recording. We eFile it with the Fulton County Clerk of Superior Court through the GSCCCA eFile portal, with the ID verification Georgia now requires.
- Service. Within 2 business days of filing we mail the owner a copy by certified mail or statutory overnight delivery, and the prime contractor too when a Notice of Commencement is on file.
Example: a Fulton County deadline walk-through
Example: A tile sub's last day on a Sandy Springs condo job is September 9. The claim of lien has to be eFiled with the Fulton County Clerk of Superior Court by December 8 (90 days), with the parcel ID from the Board of Assessors, and the owner copy mailed within 2 business days after filing.
Lien deadline passed or the lien didn't pay?
The debt is still owed. We collect unpaid Fulton County construction invoices through construction collections on contingency, 10% to 33%, with no charge if we don't collect.

Where do you file a Fulton County mechanics lien?
With the Real Estate Division of the Fulton County Clerk of Superior and Magistrate Courts, which records all Fulton County deeds, lien filings and plats. The main office is at 136 Pryor Street SW in downtown Atlanta, with North and South service centers.
Why does Fulton County need the parcel ID on a lien?
Since August 27, 2018, HB 1036 has required tax parcel ID information on documents recorded in Fulton County real property records. We pull the parcel ID from the Board of Assessors before we file.
How fast does Fulton County record an eFiled lien?
The Clerk processes documents submitted through an eRecording vendor or GSCCCA within 2 to 3 business days. Documents submitted other ways can take up to four weeks, which is why we eFile every Fulton lien.
My job has an Atlanta address. Is it always a Fulton County lien?
No. The City of Atlanta reaches into DeKalb County, Mountain Park extends into Cherokee, and Palmetto into Coweta. The lien goes to the clerk of the county where the parcel sits, so we confirm the county before filing.
