How filing works in Minnesota

Minnesota requires two things inside 120 days: recording and service on the owner. We do both, and we confirm whether the property is abstract or Torrens so the lien goes to the right office. Liens are recorded with the county recorder (or registrar of titles for Torrens property).

What trips people up in Minnesota

  • Filing alone isn't enough. The lien statement must also be served on the owner within the same 120 days.
  • GCs lose lien rights if the prelien notice isn't in their owner contract.
  • Large commercial projects over 5,000 sq ft and buildings over 4 units are exempt from the prelien notice.

What we need from you

  • Property address and owner name if you have it
  • Who hired you and their contact info
  • Your contract, bid or work order
  • Unpaid invoices and the amount owed
  • Your first and last day of work or delivery
  • Copies of any notices you already sent

Frequently asked questions

What's the Minnesota lien deadline?

120 days after your last work, and the lien must be both filed and served on the owner in that time.

Do I need a prelien notice in Minnesota?

GCs put it in the owner contract; subs and suppliers send it within 45 days of first furnishing, with some large-project exemptions.

What is Torrens property?

Registered land recorded with the registrar of titles instead of the county recorder. We check which applies before filing.

This page is general information, not legal advice. LevelSet Collections is not a law firm; we prepare and file liens and notices as agent for the claimant. Deadlines change and depend on the facts of your job, so confirm your dates with us before relying on them.
